These Terms and Conditions ("Terms") govern your use of the services provided by Launch TV Pty Ltd (trading as Launch TV Channels) ("we", "us", "our"), a Connected TV channel creation and hosting service, ABN 679 910 939, based in Australia. By placing an order or using our services, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree with any part of these Terms, you must not use our services.
Launch TV Pty Ltd (trading as Launch TV Channels) provides the following services:

Our services are structured as a one-time setup fee plus an ongoing monthly hosting fee:
All prices are in Australian Dollars (AUD) and are exclusive of GST. GST will be added for Australian customers at the current rate.
The setup fee is due in full prior to commencement of design and development work. Monthly hosting fees are billed in advance on a monthly basis. We accept payment by credit card, bank transfer, and other payment methods as specified on our website.
If any payment is overdue by more than 14 days, we reserve the right to suspend or terminate your channel hosting until outstanding amounts are settled.
You may cancel your monthly hosting subscription at any time by providing 30 days written notice to support@launchtv.com.au. Upon cancellation:
Your Content: You retain full ownership of all content, branding assets, logos, videos, and other materials you provide to us. By providing content, you grant us a non-exclusive licence to use that content solely for the purpose of building and operating your channel.
Our Work: Upon full payment of the setup fee, we assign to you the custom design and channel code we create specifically for your channel. Our underlying frameworks, tools, and proprietary systems remain our intellectual property.
You warrant that all content you provide does not infringe the intellectual property rights of any third party, and you indemnify us against any claims arising from your content.
You are responsible for ensuring that all content published on your channel complies with:
We reserve the right to refuse to publish, or to remove, any content that we reasonably believe violates platform policies, applicable laws, or is otherwise harmful, offensive, or inappropriate.
We submit your channel to the relevant platform store(s) on your behalf. However, approval decisions are made solely by Roku, Apple, and/or Amazon. We cannot guarantee approval, and we are not liable for any delays or rejections by platform operators. We will work with you to address any issues raised by platform reviewers.
To the maximum extent permitted by law, our total liability to you in connection with our services shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, or consequential damages, including loss of revenue, loss of profits, or loss of data, arising from your use of our services.
We aim to maintain high availability of our hosting infrastructure. However, we do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for any losses arising from service interruptions beyond our reasonable control.
We reserve the right to modify our services and pricing. We will provide at least 30 days notice of any price increases. Continued use of our services after the effective date of a price change constitutes acceptance of the new pricing.
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
